The Eighth District Court of Appeals, Ohio has set a temporary ruling on those filing asbestos claims, despite appeals to block the ruling until further investigation and evidence has been presented.
The new ruling means that those that have been exposed to asbestos cannot file a lawsuit unless they are actually suffering the effects of asbestos exposure in the form of ill effects. This is something that will need to be confirmed by a doctor in order for the suit to be eligible.
Asbestos exposure can cause a range of health issues, most notably leading to the deadly cancer, mesothelioma. However, his cancer can take decades to develop, so many people may not know whether or not they have this illness for thirty to fifty years following exposure.
This is the nation’s first stateside law that required conclusive medical evidence before an asbestos lawsuit can be filed through court.
